02Age limit and eligibility to buy

Browsing the Site is open to everyone. Buying on the Site is permitted only to those who are at least 18 years old and legally competent to enter into a binding agreement. When buying on behalf of a company, business or organization, the buyer declares that they are authorized to bind that body to these terms, and the license will be registered in the name of the body stated at the time of purchase.

03Products and licenses

The products sold on the Site are digital font files. A purchase does not grant ownership of the font, only a license to use it, according to the license type purchased and the company size selected at the time of purchase (Small — up to 5 people; Medium — up to 15; Large — up to 25; Very large — up to 50; Enterprise (over 50 people) — by quotation):

  • Desktop license: OpenType files for installation on the company’s workstations, up to the number set by the selected company size, for use in design and word-processing software and for embedding in PDF files for print.
  • Web license: files in web formats (woff / woff2) for embedding on the company’s own websites only, on up to the number of domains set by the selected company size.
  • App license: files for embedding in the company’s apps, up to the number set by the selected company size.

The full terms of each license, including the prohibition on copying, modifying, distributing or reselling the files, are set out in the License Agreement further down this page, which forms an integral part of these terms. If your needs go beyond the existing licenses (for example broadcast, physical products for sale, a large organization or use in a logo), write to us and we will arrange an extended license.

The fonts are provided as is. Before buying you can examine the fonts in the samples and the type tester on the Site. We recommend making sure that the font and the format suit your needs and the software you use.

04Ordering, prices and payment

Prices on the Hebrew Site are stated in New Israeli Shekels, and on the English Site in US dollars. The prices shown do not include VAT. For buyers whose billing address is in Israel, VAT is added at checkout as required by law, and the final amount is shown before the order is confirmed. No VAT is charged to buyers outside Israel. We may update prices from time to time; the binding price is the price shown when the order is completed.

Payment is made through secure external payment providers (credit card, Bit or PayPal) or by bank transfer. On the English Site, payment is made through PayPal, including by credit card without a PayPal account. Payment details are not stored on the Site’s servers. Completion of the order is subject to approval of the transaction by the card company or payment provider. When the order is completed, a tax invoice/receipt is sent to the email address provided, in the currency in which the payment was made.

05Delivery policy

The products sold on the Site are digital only and are not shipped physically. Delivery works as follows:

  • As soon as payment is approved, a link to download the files is shown on the order confirmation page, and the same link is sent to the email address given in the order.
  • The download link is not limited in time or in number of downloads, so the files can be downloaded again at any time.

If something goes wrong and the link has not arrived within an hour of payment (please also check your spam folder), contact us by email or phone and we will send the files manually within one business day at most.

It is the buyer’s responsibility to provide a working email address. Hafontia is not responsible for non-receipt of the files due to a wrong address or mail filtering on the buyer’s side, but will in any case help to locate and complete the delivery.

06Cancellation and refunds

Cancellation of a transaction is governed by the Israeli Consumer Protection Law, 5741–1981, and the Consumer Protection Regulations (Cancellation of a Transaction), 5771–2010, subject to the following.

Cancellation before the files are downloaded

A buyer may cancel the transaction within 14 days of making it, provided the font files have not yet been downloaded. In that case the full amount paid will be refunded.

Cancellation after the files are downloaded

Under regulation 6(a) of the Cancellation of a Transaction Regulations, the right to cancel does not apply to “goods that can be recorded, transcribed or duplicated, whose original packaging the consumer has opened”, or to information as defined in the Computers Law. Font files are a digital product that can be duplicated, and downloading them is equivalent to opening the packaging. Therefore, once the files have been downloaded the transaction cannot be canceled and no refund will be given, except in the case of a defect.

A defective product or one that does not match its description

If the files turn out to be defective, do not match the description on the Site, or have a technical fault we cannot resolve, we will replace the files or, if you prefer, cancel the transaction and refund the full amount. Please contact us within 14 days of the download with a description of the problem.

A mistaken purchase

Bought the wrong license or weight? Contact us as soon as possible, and where appropriate we will gladly convert the purchase to the right license, with payment or credit of the difference. A license upgrade (for example from Desktop to Web) is possible at any time.

A buyer who is a person with a disability, a senior citizen or a new immigrant

may cancel the transaction within four months of making it, subject to section 14C1 of the Consumer Protection Law and provided the transaction included a conversation with the business. The exception for files that have already been downloaded applies to such a buyer as well.

How to cancel

A cancellation notice should be given in one of the following ways, stating the buyer’s name, the order number and the email address used for the purchase:

  • By email: ben@hafontia.com
  • By phone: 052-4722090
  • By registered mail: Hafontia Ltd., 22 Kikar Kedumim, Tel Aviv–Yafo

When a transaction is canceled the license is canceled with it, and the buyer must delete every copy of the files in their possession.

07Intellectual property

All rights in the fonts, the files, the font names, the samples, the texts and the design of the Site belong to Hafontia and are protected by copyright and intellectual property law in Israel and worldwide. The font files, or any part of them, may not be copied, modified, reverse-engineered, distributed, rented, sold or made available to the public except in accordance with the license bought. Using the fonts without a valid license is a copyright infringement.

08Privacy policy

Hafontia respects your privacy and acts in accordance with the Israeli Protection of Privacy Law, 5741–1981, and its regulations.

The information we collect

Information you knowingly give us, when you contact us, make a purchase or sign up for updates: full name, email address, the details of your message or inquiry, and the order details (the fonts bought and the license type). Payment details are processed directly by the payment provider and are not stored by us.

Information collected automatically while you browse the Site: IP address, browser and device type, operating system, the pages you visited, the time spent on them and how you reached the Site, by means of cookies and statistical analysis tools.

What we use the information for

To carry out the order and deliver the files, to issue an invoice, to register the license in the buyer’s name, to provide support, to keep records as required by law, and to improve the Site. Marketing email is sent only to those who have explicitly agreed to it, and you can unsubscribe at any time. We do not sell or rent your personal information to third parties for their marketing purposes.

Transfer of information to third parties

The information will not be sold or transferred to third parties, except to suppliers acting on our behalf and only to the extent needed to provide the service (the payment provider, the Site’s hosting provider, the e-commerce platform WooCommerce, mailing services for those who signed up voluntarily, and Google Analytics), or where required by law or to protect our rights. These suppliers are bound to keep the information confidential and to use it only to provide the service for us.

Cookies

The Site uses cookies to operate the cart and sign-in, and for statistical analysis through Google Analytics. You can block or delete cookies in your browser settings at any time, but some of the Site’s functions may be affected as a result.

Security and retention

We take reasonable measures to secure the information, including encrypted communication (SSL), restricting access to authorized persons only, and not storing credit card details on the Site’s servers. Even so, complete protection against every breach cannot be guaranteed. The information is kept for as long as the license is in force and as required by law for accounting purposes.

Your rights

You are entitled to review the information kept about you, to ask for it to be corrected or deleted (subject to legal record-keeping duties), to object to its use for direct mailing and to ask to be removed from the mailing list. For any privacy request, contact ben@hafontia.com.

Minors

The Site is not intended for minors under 18, and we do not knowingly collect information from minors. If we learn that such information has been collected, we will act to delete it.

09Limitation of liability

The Site and the fonts are provided as is. Hafontia makes an effort to ensure the files are sound and compatible with common software, but does not guarantee that the fonts will suit every program, operating system or browser, or that the Site will operate without interruption. Hafontia’s liability towards the buyer will in no case exceed the amount paid for the relevant license. Nothing here detracts from consumer rights under law that cannot be waived.

10Changes to the terms

Hafontia may update these terms from time to time. The updated version will be published on this page with the date of the update, and will apply to purchases made after its publication. Licenses already bought remain subject to the terms in force when they were bought.

11Governing law and jurisdiction

These terms are governed solely by the laws of the State of Israel. Exclusive jurisdiction in any dispute concerning the Site or a purchase on it lies with the competent courts of the Tel Aviv–Yafo district.

13Accessibility statement

Hafontia Ltd. attaches great importance to providing equal service to the whole public, including people with disabilities, and works to make the Site accessible in accordance with the Israeli Equal Rights for Persons with Disabilities Law, 5758–1998, and the Equal Rights for Persons with Disabilities Regulations (Service Accessibility Adjustments), 5773–2013.

Level of accessibility on the Site

The Site was made accessible following Israeli Standard 5568, which is based on the WCAG 2.1 guidelines at level AA, and was tested in Chrome, Safari and Firefox together with the VoiceOver screen reader. The adjustments include: semantic page structure with ordered headings and correct language and text-direction markup; full keyboard navigation, including menus, the cart, forms and the font display; color contrast that meets the standard, and text that can be enlarged up to 200% without loss of content; alternative text (alt) for images, and clear labels for form fields and buttons; no flashing content or automatic motion that cannot be stopped.

Known limitations

Despite our efforts, some parts of the Site may not yet be fully accessible, in particular interactive font samples, older PDF font specimens, and third-party components (such as PayPal’s payment pages) that are not under our control. We keep improving accessibility on an ongoing basis.

Run into a problem? Tell us

If you have had difficulty browsing the Site or receiving service, we will be glad to help and to fix it. Please contact Ben Nathan, who is responsible for the Site’s accessibility, describing the problem, the browser and the assistive technology you used: ben@hafontia.com or 052-4722090. We try to answer accessibility inquiries within two business days. Alternatively, any information or service available on the Site can also be obtained by contacting us directly by email or phone.

Part B

Font End User License Agreement (EULA)

This agreement is made between Hafontia Ltd. (“Hafontia”) and whoever bought a license to use a font through the Site or received it from Hafontia in another way (the “User”). Downloading, installing or using the font files constitutes agreement to the terms of this agreement.

01Nature of the license

The license is an End User License Agreement (EULA) that defines the permitted ways of using the fonts. On purchase the User receives a right of use only, according to the type of license bought, and not ownership of the font, the design or the files. All rights not expressly granted are reserved to Hafontia.

02Types of license

Company size

The price of each license is set by the company size the user selects at the time of purchase: Small — up to 5 people; Medium — up to 15; Large — up to 25; Very large — up to 50; Enterprise (over 50 people) — by quotation. Company size is the number of people in the company, employees and regular freelancers, on the day of purchase. The number in the selected size sets the scope of each license: the number of workstations (Desktop), the number of domains (Web) and the number of apps (App). For example, for a small company: up to 5 workstations, up to 5 domains and up to 5 apps. One size applies to all licenses in the same order and is stated on the order. A company that grows beyond the selected size must update its license; write to us and we will update it.

Desktop license

Font files in OpenType (OTF) format for installation on the user’s workstations, up to the number set by the selected company size (small company: up to 5 workstations). The license permits use in graphics software and word processors for any purpose, including commercial use: design, print, branding, logos, packaging, signage, presentations, video and still images. The font may be embedded in closed files (such as PDF) for viewing and printing, provided the font files cannot be extracted from them.

Web license

Font files in web formats (woff / woff2) for use on domains (websites) owned or managed by the user, up to the number set by the selected company size (small company: up to 5 domains). The license is intended for displaying the font on websites by means of @font-face only. These files may not be installed on a computer or used in applications other than websites. The files must be reasonably protected on the server against direct download.

App license

Font files in TrueType (TTF) format for embedding in the user’s apps, up to the number set by the selected company size (small company: up to 5 apps). Each app is counted by its name and store identifier, across all its platforms and versions. The license does not permit the app to let its end users extract, export or use the font outside the app.

Additional licenses

Uses beyond the licenses above — such as television broadcast, physical products in which the font is the main element (for example stencils, stamps or physical letters for sale), operating systems, companies of more than 50 people (Enterprise), or more domains or apps than the selected size allows — require an extended license. Write to ben@hafontia.com and we will arrange a license.

03What is not allowed

  • Copying, distributing, lending, renting, selling, transferring or sharing the font files with a third party, including clients, print suppliers or freelancers (each of whom needs a license of their own).
  • Modifying, editing, reverse-engineering, disassembling, converting to another format or creating derivative works from the font files without written permission from Hafontia. Agreed modifications will be made by Hafontia or with its approval, and the copyright in the modified version will remain with Hafontia.
  • Embedding the font in documents or files in a way that allows the text to be edited or the font to be extracted by someone who has no license.
  • Using the font to create a product that competes with the font itself, such as another font, a digital letter set or an alphabet for sale.
  • Using the name of the font or the name Hafontia in a way that implies sponsorship or partnership without permission.

04Ownership and copyright

The fonts, their design, the font files, the documentation and the names are the exclusive property of Hafontia and are protected by copyright and intellectual property law. The copyright notices must be kept as they appear in the files.

05Versions, updates and support

Hafontia may, but is not obliged to, publish updates to the fonts. Updates published for a font family that was bought will be available to the User at no extra charge through the download link. Hafontia will help with technical questions about the files, but does not undertake to support third-party software, operating systems or browsers.

06Termination of the license

The license is granted without a time limit, as long as the User complies with this agreement. A breach of the agreement terminates the license immediately, and on termination the User must delete all copies of the files in their possession. Termination of the license does not detract from any other remedy available to Hafontia by law.

07Liability

The fonts are provided as is. Hafontia is not liable for indirect or consequential damage arising from use of the fonts, and its total liability will not exceed the amount paid for the license.

Frequently asked questions

May the fonts be used commercially?
Yes. Every license allows commercial use, as long as it is within the type of license bought.
Which formats do the files come in?
OTF for the Desktop license, woff / woff2 for the Web license, TTF for the App license. If you need another format, write to us.
Who should buy the license, the designer or the client?
The license is registered in the name of whoever actually uses the files. A designer who buys a license can use the font in work for clients, but if the client needs the files themselves (for example to install in their office or on their website), they need a license of their own.
How do I install the font?
On a Mac: double-click the OTF file, then “Install Font”. On Windows: right-click the file, then “Install”. After installing, restart any open applications.
How do I embed the font in a website?
Upload the woff / woff2 files to the server and declare them in CSS with @font-face. We are happy to help if something does not work.
Can the font be edited?
No, except with written permission from Hafontia. Modifications are made by us or in coordination with us.
What about variable fonts?
When a font family is also available as a variable font, it is included in the purchase of the full family, under the same license terms.
